Child Support

Child support in Florida is the right of the child.  Child support may need to be addressed in an action for Dissolution or Paternity or can simply be requested by a parent who believes that the child is entitled to financial assistance from the other parent.

The primary statute governing child support in Florida is §61.30. Child support guidelines; retroactive child support.  The statute sets out a formula that the Court must use to determine who owes child support and in what amount.  Information is needed to calculate child support.  The income of each party, the cost of health insurance for each party with a breakdown as to the cost of the coverage for the parent versus the parent and the minor child, mandatory deductions for each party, the amount each parent pays for child care costs  and the number of overnights each parent will spend with the minor child.

If the parent with the minor child receives food stamps, Medicaid or other public assistance for the child at some point the department of revenue will commence legal action to against the child’s other parent to assist the struggling parent obtain child support to help improve the financial circumstances of the child.  Similarly, if the parent who makes less money decides they need financial assistance they may file a request for child support.
