Divorce in Florida is known as a Dissolution of Marriage.  If at least one party has lived in Florida for the last six months, then Florida may be an appropriate venue to dissolve the marriage.  Florida is a no-fault state, which means that if either party simply says that the marriage is “irretrievably broken” the Court will enter a final judgment of dissolution and return each of the parties to the status of being single.

The process is fairly simple.  The party seeking the divorce files a Petition requesting the Court grant them a divorce and any additional relief they are seeking.  The other party can file a motion, do nothing, file an answer or they can file an answer and counter-petition.   The parties are required to provide each other with financial information through filing detailed financial affidavits, exchange of mandatory documents and responses to discovery requests.  When there are children involved each parent must take an approved parent education course.  If the parties agree on all issues they can enter into the appropriate agreements and schedule a final hearing.  If the parties do not agree on all the issues, they will be required to attend mediation before the Court, will set the matter for trial.
