Paternity actions in Florida are typically brought by a Father who is seeking to legally establish his rights as well as the rights of his child.  Florida law entitles an unwed Father the same right to shared parental responsibility and equal timesharing, barring a showing that it would not be in the best interest of the minor child, as any other parent.  To legally establish these rights a Petition to Establish Paternity and Related Relief must be filed and served upon the Mother.

A Petition for paternity can be filed on your own, with the assistance of an attorney or by an attorney on your behalf.  What is important to remember is that the Court can only grant the relief you request so it is important to make sure that you ask the Court for everything you want them to Order if your case does not get resolved prior to trial.

Establishing Paternity is also important for the emotional and financial well being of the minor child.  Once Paternity is established the minor child will have a sense of belonging and become eligible for benefits such as social security, health insurance, survivors’ benefits, military benefits, and inheritance rights.
